FINANCE


1. REPORT OF ADMINISTRATION APPROVED CONTRACTS

The attached summaries are provided as information in accordance with Board Policy 8361. The summaries list all change orders, and contracts having a value greater than $50,000 and not over $100,000, and purchase orders in excess of $250,000 for July and August, 2007. Fiscal Implications: Not applicable. Recommendation for Action: Not applicable.

FACILITIES


1.BIDS: ENLOE HIGH BOILER UPGRADE

Bids were received on August 2, 2007 for the Enloe High boiler upgrade. The existing boilers on west campus are approximately 50 years old, and they have deteriorated to the point that they can no longer be repaired re-certified for use by the North Carolina Department of Labor. Staff recommends award of the $247,506 contract to Welding Specialties and Mechanical Services, Inc. Fiscal Implications: Funds are available from the Plan 2000 Modernization Budget. Recommendation for Action: Board approval is requested.

2.BIDS: SIX-CLASSROOM MODULAR UNIT FOR LINCOLN HEIGHTS ELEMENTARY

Bids were received on August 28, 2007 for relocating and connecting/installing all services (power, water, sewer, data, ADA access, fire protection, and security) required for permitted occupancy for a six classroom modular unit at Lincoln Heights Elementary School. Staff and H. S. Annis Architect, AIA, recommend award of the single-prime contract to C. Blake Lewis Construction in the amount of $246,935. Fiscal Implications: Funding is available from the total project budget of $16,935,553, all of which is from the CIP 2006 Mobile Classroom Relocation and Leasing, 2007-2009 project. Recommendation for Action: Board approval is requested.

3.BIDS: REPLACEMENT OF FIRE ALARM SYSTEM AT MORRISVILLE ELEMENTARY

Bids for the replacement of the fire alarm system at Morrisville Elementary were received on August 28, 2007. Staff and United Engineering Group, Inc. recommend award of a single-prime contract to North Carolina Systems Service Company in the amount of $119,833. Fiscal Implications: Funding is available from the total PLAN 2000 Priority Needs project budget of $1,947,628. Recommendation for Action: Board approval is requested.


4.CHANGE ORDER CM-03: SYCAMORE CREEK ELEMENTARY (E-17)

Board approval is requested for Change Order CM-03 to Barnhill Contracting Company for their Construction Manager at Risk contract to construct Sycamore Creek Elementary. This change order, in the amount of $12,862,977, is to establish a guaranteed maximum price (GMP) for the "Release 2" package, which includes 33 of the 41 construction packages for this project. A list of bid packages is attached. The total GMP for this project is $20,000,136. This is $2,817,855 over budget, primarily due to site conditions and the accelerated work schedule needed to complete this school for a delayed year-round opening in August 2008. Fiscal Implications: The total proposed project budget is $24,699,862, of which $1,708,291 is from PLAN 2004 and $21,273,716 is from CIP 2006. A reallocation from CIP 2006 Program Contingency will be presented in the future to provide the $1,717,855 in additional funds. Recommendation for Action: Board approval is requested.


5.UTILITY EASEMENT: AVERSBORO ELEMENTARY

As part of the renovation project and in order to provide electrical service to the Aversboro Elementary site, Progress Energy Carolinas, Inc., requires an underground utility easement to construct, maintain, and operate electric and/or communication facilities thereon, consisting of poles, cables, wires, underground conduits, enclosures and other pertinent facilities. The easement to be granted will allow for installation of utility service equipment where needed upon the site, with the precise location to be determined by mutual agreement and to be memorialized by site maps or drawings upon installation. The requested easement will not interfere with the Wake County Public School System's present or future use of the property. A copy of the proposed Easement is attached. Fiscal Implications: None. Recommendation for Action: Staff request Board approval.

6.DEED OF EASEMENT - CITY OF RALEIGH: ROAD WIDENING PROJECT (SWIFT CREEK ELEMENTARY AND DILLARD DRIVE ELEMENTARY)

The City of Raleigh is improving and widening Tryon Road, Yates Mill Pond Road and Dillard Drive to relieve congestion and reduce travel time. The City plans to begin construction in September 2007 and construction should last approximately 18 months.
The effect of the roadway improvements on Swift Creek Elementary (Tryon Road/Yates Mill Pond Road) will include the removal of plant and landscape materials, the relocation and reinstallation of the school sign to a location of the WCPSS' choice, and modifications to the access to and from the campus parking lots. Multiple easements have been requested by the City and are stated within the proposed Deed of Easement. They are: a Street Right-of-Way Easement; a Sloping Easement; an Electric Utility Easement; a Temporary Construction Easement; and a Temporary Easement for Driveway Repair and Reconnection. The City will compensate the Board of Education for the acquisition of all easements required along Tryon and Yates Mill Pond Roads. A copy of the Deed of Easement and the Easement Plat is attached with the areas of the easements identified thereon.
The effect of the roadway improvements on Dillard Drive Elementary (Dillard Drive) is minimal and the City requests that a temporary construction easement be granted by the Board of Education to accommodate the improvements. The requested easement will not substantially interfere with the present or future use of the property. A copy of the Deed of Easement and the Easement Plat is attached with the areas of the easements identified thereon. Fiscal Implications: 1) The City of Raleigh will compensate the Wake County Board of Education in the amount of $71,500 for the easements involving Swift Creek Elementary. Funds will be allocated to the General Fund. 2) There is no fiscal impact concerning the temporary construction easement involving Dillard Drive Elementary. Recommendation for Action: Staff requests Board approval.

7.OFFER TO PURCHASE AND CONTRACT FOR SALE OF SURPLUS LAND: 2.8 ACRES OF THE LEESVILLE ROAD CAMPUS

The Board of Education owns 104.91 acres of land on Country Trail known as the Leesville Road Schools tract that it currently uses for Leesville Road High School, Middle School and Elementary School. It includes an unusable portion at the southern end of the property that is separated from the main body of the tract by Country Trail and is adjacent to a tract owned by City of Raleigh and consists of approximately 2.8 acres of the property. The Board of Education declared it as surplus property and ordered its sale on March 6, 2007. At its March 12, 2007 meeting, the Wake County Board of Commissioners confirmed that the County had an interest in acquiring the surplus property at fair market value. Terms and conditions of an Offer to Purchase and Contract have been reached to sell the 2.8 acre surplus tract to Wake County at a purchase price of $450,000. The property is further identified as portion of Wake County PIN #0787386736, and Wake County Tax Account #0064017. Fiscal Implications: Estimated income to the Board of Education for future land acquisitions for schools is $450,000. Recommendation for Action: Staff requests Board approval.

8.RIGHT OF WAY ACQUISITION AND DEDICATION (SMITH PROPERTY): BANKS ROAD ELEMENTARY

As a part of the development of Banks Road Elementary and the construction approval process, the North Carolina Department of Transportation and Town of Fuquay-Varina are requiring road improvements to Banks Road and Chambers Road. To complete the improvements and as a condition of site approval, it is necessary that WCPSS acquire a right-of-way dedication and a temporary construction easement totaling 0.13 acres as shown on the attached plat. Extensive mature landscaping improvements located within the right-of-way dedication area will be destroyed in the road improvement process, which will have an adverse impact upon the property owner's remaining property. Proposed compensation to acquire the land needed for the right-of-way dedication, temporary construction easement acquisition and to compensate the landowner for the loss of extensive landscaping improvements totals $13,225. Fiscal Implications: The Board will compensate the property owner in the amount of $13,225 from the CIP 2006 Land Purchase account. Recommendation for Action: Board approval is requested.

9.TEMPORARY CONSTRUCTION EASEMENT AND RIGHT-OF-WAY DEDICATION (MCLAMB PROPERTY): BANKS ROAD ELEMENTARY

As part of the development of Banks Road Elementary, it is necessary to make road improvements along Banks Road to address traffic and safety concerns, and to accommodate required improvements. Due to the road widening, asphalt paving and the installation of curbing and gutters, grading and erosion control impacts to a neighboring property necessitates obtaining a temporary construction easement (880 square feet) along Banks Road from property owner, James W. and Thelma C. McLamb. In addition, a 500 square feet portion of the McLamb property must be acquired for a right-of-way dedication to the Department of Transportation. To allow construction to proceed on schedule these easements must be acquired. A copy of an Easement Plat is attached with the area of the easements identified thereon. Fiscal Implications: The Board will compensate the property owner the combined total amount of $375 from the CIP 2006 Land Purchase account. Recommendation for Action: Staff request Board approval.

10.TEMPORARY CONSTRUCTION EASEMENT AND RIGHT-OF-WAY DEDICATION (HOCKADAY PROPERTY): BANKS ROAD ELEMENTARY

As part of the development of Banks Road Elementary, it is necessary to make road improvements along Chambers Road to address traffic and safety concerns, and to accommodate required improvements. Due to the road widening, asphalt paving and the installation of curbing and gutters, grading and erosion control impacts to a neighboring property necessitates obtaining a temporary construction easement (4800 square feet) along Chambers Road from property owner, Linda S. Hockaday. In addition, a 250 square feet portion of the Hockaday property must be acquired for a right-of-way dedication to the Town of Fuquay Varina. To allow construction to proceed on schedule these easements must be acquired. A copy of an Easement Plat is attached with the area of the easements identified thereon. Fiscal Implications: The Board will compensate the property owner the combined total amount of $837 from the CIP 2006 Land Purchase account. Recommendation for Action: Staff request Board approval.


11.TEMPORARY CONSTRUCTION EASEMENT (BUFFALOE PROPERTY): BANKS ROAD ELEMENTARY

As part of the development of Banks Road Elementary School, it is necessary to make road improvements along Banks Road to address traffic and safety concerns, and to accommodate required improvements. Due to the road widening, paving and installation of curbs and gutters, grading and erosion control impacts to a neighboring property necessitates obtaining a temporary construction easement along Banks Road from property owner, Lacy Buffaloe, Jr. To allow construction to proceed on schedule, a 1500 square feet temporary construction easement (ten feet wide) is required. A copy of an Easement Plat is attached with the area of the easement identified thereon. Fiscal Implications:
The Board will compensate the property owner in the amount of $188 from the CIP 2006 Land Purchase account. Recommendation for Action: Staff request Board approval.


12.TEMPORARY CONSTRUCTION EASEMENT (CHRISTENSEN PROPERTY): BANKS ROAD ELEMENTARY

As part of the development of Banks Road Elementary School, it is necessary to make road improvements along Banks Road to address traffic and safety concerns, and to accommodate required improvements. Due to the road widening, paving and installation of curbs and gutters, grading and erosion control impacts to a neighboring property necessitates obtaining a temporary construction easement along Banks Road from property owner, Ruth E. Christensen. To allow construction to proceed on schedule, a 1750 square feet temporary construction easement (ten feet wide) is required. A copy of an Easement Plat is attached with the area of the easement identified thereon. Fiscal Implications: The Board will compensate the property owner in the amount of $250 from the CIP 2006 Land Purchase account. Recommendation for Action: Staff request Board approval.


13.TEMPORARY CONSTRUCTION EASEMENT (CORBETT PROPERTY): BANKS ROAD ELEMENTARY

As part of the development of Banks Road Elementary School, it is necessary to make road improvements along Chambers Road to address traffic and safety concerns, and to accommodate required improvements. Due to the road widening, paving and installation of curbs and gutters, grading and erosion control impacts to a neighboring property necessitates obtaining a temporary construction easement along Chambers Road from landowners, Wayne and Carol Corbett. To allow construction to proceed on schedule, a 2620 square feet temporary construction easement (ten feet wide) is required. A copy of an Easement Plat is attached with the area of the easement identified thereon. Fiscal Implications: The Board will compensate the property owner in the amount of $375 from the CIP 2006 Land Purchase account. Recommendation for Action: Staff request Board approval.

14.TEMPORARY CONSTRUCTION EASEMENT (WOODARD PROPERTY): BANKS ROAD ELEMENTARY

As part of the development of Banks Road Elementary School, it is necessary to make road improvements along Banks Road to address traffic and safety concerns, and to accommodate required improvements. Due to the road widening, paving and installation of curbs and gutters, grading and erosion control impacts to a neighboring property necessitates obtaining a temporary construction easement along Banks Road from property owner, Robert T. and Sheryl C. Woodard. To allow construction to proceed on schedule, a 1750 square feet temporary construction easement (ten feet wide) is required. A copy of an Easement Plat is attached with the area of the easement identified thereon. Fiscal Implications: The Board will compensate the property owner in the amount of $250 from the CIP 2006 Land Purchase account. Recommendation for Action: Staff request Board approval.


INSTRUCTIONAL PROGRAM


1. AGREEMENT BETWEEN EXCEPTIONAL CHILDREN'S ASSISTANCE CENTER AND WAKE COUNTY PUBLIC SCHOOL SYSTEM

oProject Enlightenment is a model demonstration and training center for the national Parents As Teachers (PAT) program that promotes school readiness and parent involvement.
oSince 1995, the Exceptional Children's Assistance Center has contracted with Project Enlightenment to provide PAT services for families, develop and distribute quarterly newsletters, plan and host state PAT Advisory meetings, and provide training and technical assistance for PAT educators.
Fiscal Implications: This is a revenue contract in the amount of $73,600. No Wake County Public School funds are required. Recommendation for Action: Staff is requesting Board approval.

POLICY


1. POLICY 2308/3008/4008 TOBACCO-FREE ENVIRONMENT

Revised: Second Reading.
Recent legislative changes included in House Bill 1086 require the revision of Policy 2308/3008/4008-tobacco-Free Environment. Revisions have been made with the input of staff, and have been reviewed by Ann Majestic. The Policy Committee reviewed and approved the recommended revisions on 8/28/07. Fiscal Implications: None. Recommendation for Action: Staff is requesting Board approval.

2. POLICY 5536/6536- FOREIGN LANGUAGE PROFICIENCY

Revised: Second Reading.
Revisions are being recommended in accordance with the recently adopted North Carolina House Bill 915. The new legislation encourages schools to offer American Sign Language classes in high schools for credit as a modern foreign language. The proposed revisions include a process for students wishing to demonstrate school language proficiency in American Sign Language. In addition, the policy has included two standardized assessment instruments student may use when wishing to receive second language credit for commonly assessed second languages, the Brigham Young University Foreign Language Achievement Testing Service, or the Sign Language proficiency. Revisions have been made with the input of staff. The Policy Committee reviewed and approved the recommended revisions on 8/28/07. Fiscal Implications: None. Recommendation for Action: Staff is requesting Board approval.

3. POLICY 6000-ATTENDANCE

Revised: Second Reading.
Revisions are being recommended in accordance with North Carolina Statute. Language has been added regarding allowable excused absences. In addition, clarifying language regarding block courses has been included. Revisions have been made with input of staff. The Policy Committee reviewed and approved the recommended revisions on 8/28/07. Fiscal Implications: None. Recommendation for Action: Staff is requesting Board approval.

4. POLICY 6201- SCHOOL ADMISSIONS

Revised: Second Reading.
Recent legislative changes require the revision of Policy 6201-School Admissions. These changes relate to revisions in the Mc-Kinney-Vento Act, House Bill 1074 (of the 2006 session), House Bill 150, House Bill 1357, and updates regarding Student Due Process procedures.

1.The McKinney-Vento Act and the North Carolina General Assembly require local school boards to develop and implement a process for parents, guardians, or unaccompanied youth who have complaints about enrollment to file an appeal with the district's Homeless Liaison upon registering or attempting to at the school. Enrollment shall be deemed to include attending classes and participating fully in school activities. The burden shall be on the school or the Homeless Liaison to show that the student is not a homeless student or unaccompanied youth.

2.House Bill 150 modified admission requirements for students entering kindergarten. The legislation changes the age requirement stating that a child can be enrolled for kindergarten if the child reaches or reached the age of 5 on or before August 31, rather than October 16, of the school year. This new cut off date will become effective with the 2009-2010 school year.

3.House Bill 1357 states that a student who is not a domiciliary of a local school administrative may attend, without payment of tuition, the public schools of the unit if his or her parent or legal guardian is on active military duty and is deployed out of the local school administrative unit in which the student resides.

4.The Office of Student Due Process has made minor revisions to align the policy with current practices.
Revisions have been made with the input of staff, and have been reviewed by Ann Majestic. The Policy Committee reviewed and approved the recommended revisions on 8/28/07. Fiscal Implications: None. Recommendation for Action: Staff is requesting Board approval.

1. RESOLUTION: CIP 2006 FUNDING REALLOCATION OF RESERVE FUNDS

A Reserve Fund has been created in CIP 2006 from projects that were initially over-funded, bid under the established budgets, or no longer require funding. At present, there is $43,854,620 in the fund. Resolution requests reallocations of funds as follows: a) to Smith Elementary to increase the size of the school to 51 teaching spaces; b) to provide additional funds for H-6, M-6, E-21, and E-25 new school projects in order to extend the opening dates by 1 year, due to not having land available to meet planned opening dates; and c) to reserve funds for potential additional mobile classroom relocation and leasing to accommodate projected increased student enrollment. Total reallocation request is $12,522,765. Fiscal Implications: Additional projects can be funded within CIP 2006 reserve fund, while using Program Contingency to fund unexpected needs such as projects bidding over their established budget. The reallocation is for approximately $12.5 million of the $43.8 million in the reserve fund; additional reallocation requests will be made at a later date. Recommendation for Action: Board approval is requested.
