PROGRAM


1. No Child Left Behind
The new federal education legislation, No Child Left Behind (NCLB), or Elementary and Secondary Education Act (ESEA), brings a number of significant changes.
-Grants have been reorganized and overall funding allotments will increase. However, requirements and sanctions are also greater.
-The accountability requirements have increased and are much more specific than in the past. Adequate Yearly Progress (AYP) sets incremental progress goals with the ultimate aim of 100% of students meeting state standards for achievement in 12 years.
-Teacher and paraprofessional qualification requirements have increased.
-Sanctions for Title I schools have also increased, and they grow increasingly severe over time.

FACILITIES


1. Joint Use Agreement - Creech Road Elementary
The Town of Garner has leased from Wake County 18.25 acres adjacent to Creech Road Elementary School and wishes to develop and jointly use a portion of the Creech Road campus in the school/park they are developing on the 18.25 acres. Per the joint use agreement, sections of the park property will be available for school use during the school day and sections of the school property will be available for community use during non-school hours.

2. Bids: Project 10L - Networking and Infrastructure Additions and Renovations
Over 90 percent of all classroom areas in Wake County are outfitted with fiber optic cabling from previous technology projects and/or original building construction. This project will begin to provide fiber optic cabling to limited areas that currently have only minimal copper cabling service. This project will also replace on-floor classroom copper data cabling with wall-mount cabling raceways and improve labeling of existing cabling. Where necessary, existing electrical systems will be upgraded to provide power for new and existing computers and printers. Bids were received on May 10, 2002 for networking and infrastructure additions and renovations at Durant Road Middle, Enloe High, Martin Middle, and Stough Elementary. MBE Electrical was the apparent low bidder. Bid tabulation is attached. Board approval is requested to award contract in the amount of $156,000.

3. Bids: Mechanical Renovations - Combs Elementary
Bids for the mechanical renovations at Combs Elementary were received on May 2, 2002. Staff and Skinner Lamm & Highsmith PA, Architects, recommend awarding a single-prime contract to Southern Piping Company in the amount of $178,207.

4. Bids: Partial Roof Replacement - Millbrook High
Bids for partial roof replacement at Millbrook High were received on April 25, 2002. The partial roof replacement consists of Building A (main entry, dining area, kitchen/loading area, auxiliary gymnasium, boys locker room, band room and technology lab) and Building C (science/classroom wing). Staff and Rooftop Systems Engineers, P.C., recommend award of the contract to Curtis Construction Company, Inc., in the amount of $344,422.

5. Bids: Track and Field Additions - West Cary Middle
Bids for track and field additions at West Cary Middle were received on May 9, 2002. Staff and Jerry Turner & Associates, Inc., recommend award of the single-prime contract to Thompson Contracting, Inc., in the amount of $549,549.

6. Bids: Asbestos Abatement - Fuquay-Varina Middle
Bids for the Asbestos Abatement project at Fuquay-Varina Middle were received on April 19, 2002. Staff and Froehling & Robertson, Inc., recommend award of the contract to Klein Contracting Corporation, in the amount of $118,740.

7. Bids: Fuquay-Varina Middle Addition and Renovations
Pre-approval is requested for bids, which are scheduled to be received on May 23, 2002, if the bids are within the CCAP of $11,400,000. Staff will provide recommendation for award and bid tabulations at a future board meeting. Pre-approval allows acceleration of preliminary construction activities at minimal financial risk.

8. Bids: 2002 Mobile Classrooms - Package ‘D'
Bids for the 2002 Mobile Classrooms - Package were received on May 7, 2002. Staff and Gurel Architecture recommend award of a single prime contract to Recon Corporation in the amount
of $334,890.

9. Bids: 2002 Mobile Classrooms - Package ‘E'
Bids for the 2002 Mobile Classrooms - Package 'E' were received on May 9, 2002. Staff and H.S. Annis Architect, AIA recommend award of a single prime contract to C. Blake Lewis in the amount of $368,000.

10. Bids: Stough Elementary Addition and Renovations
Bids for Stough Elementary Addition and Renovations were received on April 18, 2002. Staff and Brown & Jones Architects, Inc., recommend award of the single-prime general construction contract to Accord Contractors & Developers, Inc., in the amount of $852,800. The lowest multi-prime bid was $867,490.

11. Bids: Underwood Elementary Addition and Renovations
Pre-approval for bids was received at the May 7, 2002 board meeting. Bids for Underwood Elementary addition and renovations were received on April 25, 2002. Bids received were over the CCAP of $6,465,000 but are within the total project funds due to savings realized on demolition and asbestos abatement. Staff and Davis Kane Architects, PA, recommend award of the single-prime contract to D. S. Simmons, Inc., in the amount of $6,628,100. The total of the low multi-prime bids was $6,609,429.

12. Design Consultant Agreement: Apex Middle Addition and Renovations
The approved PLAN 2000 School Building Program includes the addition and renovations at Apex Middle. Negotiations have been completed with Cherry Huffman Architects, P.A., for the design of this project. The form of agreement is the standard form approved by the board attorney.

13. Design Consultant Agreement: E07 (Sears Farm Road) Elementary
The approved PLAN 2000 School Building Program includes a new elementary E07. Negotiations have been completed with Pearce Brinkley Cease & Lee PA for the reuse of the prototype used at Heritage Elementary (E02). This is the eighth reuse of this prototype. The form of agreement is the standard form approved by the board attorney.

14. Design Consultant Agreement: Ligon Middle Additions and Renovation
The approved PLAN 2000 School Building Program includes additions and renovation at Ligon Middle. Negotiations have been completed with Pearce Brinkley Cease & Lee PA for the design of this project. The form of agreement is the standard form approved by the board attorney.

15. Design Consultant Agreement: Northwoods Elementary Renovations
The approved PLAN 2000 School Building Program includes the renovation of Northwoods Elementary. Negotiations have been completed with Arcadis G&M of NC, Inc., for the design of this project. The form of agreement is the standard form approved by the board attorney.

16. CP&L Utility Easement - Fuquay-Varina High
To provide electrical power to the girls' softball field at Fuquay-Varina High, CP&L requires a Utility Easement for underground electrical lines approximately 10-feet wide by 40-feet in length. A new underground transformer will be installed with cable running to an existing meter.

17. Bus Parking Lease Agreement - Apex Elementary
Renovation of Apex Elementary and limited parking for buses in the Apex area requires the relocation of approximately 40 buses until a more permanent solution can be determined. Terms and conditions of a 13 month Parking Lease Agreement from June 1, 2002 to June 30, 2003, have been reached with Peakway Development, LLC, of Apex, NC for a parking lot off Perry Road near Apex Elementary.

18. Water and Sewer Line Easement - Green Hope Elementary
With the completion of Green Hope Elementary and the location of water and sewer lines by formal survey, the Town of Cary requests the dedication of a Utility Easement approximately 30-feet wide at various locations on the elementary campus.

19. Annexation Petitions: Leesville Road Complex, Stough Elementary, and Fox Road Elementary
The Leesville Road Complex, Stough Elementary and Fox Road Elementary are within the City of Raleigh's zoning jurisdiction, but have not been annexed into Raleigh's City Limits. With annexation, the City will consider allocation of school resource officers as well as other municipal services.

20. Resolution: Long-Range Building Program Funding Reallocation
Resolution requests reallocation of project savings from the Phase IIIB project at Green Hope High to Middle Creek High. Resolution also requests reallocation of project savings from the PLAN 2000 project at Leesville High to Northwoods Elementary and Powell Elementary. The designated funding within the Modernization, Environmental Compliance, and Deferred Maintenance projects for Northwoods Elementary will be reallocated to the Northwoods Elementary project. Total reallocation amount is $4,491,600.

21. Resolution: Funding For PLAN 2000 School Building Program
Resolution requests funds for the PLAN 2000 School Building Program previously approved by the board. This request will provide start-up funding for Daniels Middle and Rolesville Elementary. This request also includes the balance of funding for "Sears Farm Road" Elementary (E7) and Forestville Road Elementary (E8).

Entitlement (#647): North Carolina Department of Public Instruction, Vocational and Technical Education Program Improvement / Central Office, Curriculum and Instruction. Entitlement (#648): North Carolina Department of Public Instruction, Title I-Basic / Central Office, Curriculum and Instruction. Entitlement (#649): North Carolina Department of Public Instruction, Title I-Migrant Education / Central Office, Curriculum and Instruction. Entitlement (#650): North Carolina Department of Public Instruction, Safe and Drug-Free Schools and Communities / Central Office, Student Services. Entitlement (#651): North Carolina of Department of Public Instruction, Improving Teacher Quality / Central Office, Evaluation and Research. Entitlement (#652): North Carolina Department of Public Instruction, Education Technology State Grant / Central Office, Technology Services. Collaborative (#655): National Institute of Health, National Center on Minority Health and Health Disparities / Central Office, Curriculum and Instruction collaboration with Shaw University. Fiscal implications vary by grant. Staff recommends that the board approve the applications.

2. Transportation Contracts for Special Education Services Students
The existing transportation contract is scheduled to expire in June 2003. In light of the budget situation, current contractors (AA&D Transportation, Associated Transportation, Crystal Transportation, King Richard Transportation, and Lucas Transportation) have presented a proposal which would produce a cost savings of more than $4.7 million over the next six years. Specifically, contractors propose a rate reduction beginning with the 2002-2003 school year which would then remain constant through June 2008. The proposal also seeks extension of the contract through June 2008. An immediate savings of $355,779 would be realized in the 2002-2003 school year with an increased yearly savings thereafter through the end of the contract. Cumulative savings through June 2008 would exceed $4.7 million. Staff recommends board approval of a contract extension through June 2008 for existing contract transportation providers to include a rate reduction beginning with the 2002-2003 school year followed by a one time 5% rate increase in July 2005.

3. Transportation Agreement for Parents of Exceptional Children
Staff recommends board approval of the agreement form which is proposed to reimburse parents who transport their exceptional children to school. Reimbursement will be based on actual mileage to and from school. Funds are included in state and federal allotments. Staff recommends board approval of an agreement form.

4. Contract: School Resource Officers for 2002-2003
This contract will be made with the Town of Cary to provide school resource officers at each of the high schools located within the city. The following is a list of the schools: Middle Creek High School, Cary High School, and Green Hope High School. Funding for this contract, in the amount of $113,514 ($37,838 x 3 schools), is available through fund 69 for the 2002-2003 school year. Staff recommends this contract be approved.

5. Contract: School Resource Officers for 2002-2003
This contract will be made with the City of Raleigh to provide school resource officers at each of the high schools within the city. The following is a list of the schools: Athens Drive High School, Broughton High School, Enloe High School, Longview/Phillips High School, Millbrook High School, Sanderson High School, Southeast Raleigh High School, and Wakefield High School. Funding for this contract, in the amount of $302,704 ($37,838 x 8 schools), is available through fund 69 for the 2002-2003 school year. Staff recommends this contract be approved.

6. Contract: Richard M. Milburn High School
This is an amendment to Wake County Public School System's existing contract with Richard M. Milburn High School. The total cost of the contract is $776,250.00. Staff recommends that the Board approve the amendment.

7. Scientific Learning
FastForWord is a reading intervention program that focuses on foundational skills related to auditory discrimination. FastForWord was initiated at Creech Road and York Elementary Schools for Special Education students in 1999-2000. In 2000-2001, Durant Road Middle School was added. Success of the program initiated expansion of the pilot to 10 elementary and middle schools. The proposal is to pilot FastForWord at 10 schools so the evaluation of the materials can be conclusive. The contract provides for expansion to more schools in 2003-2004 and 2004-2005 if the evaluation is supportive. Total cost of the 2002-2003 contract shall not exceed $189,100.00, to be paid from at-risk funds. Board approval is recommended.

3. POLICY 7200 - MAINTENANCE AND OPERATIONS, FACILITIES PLANNING AND CONSTRUCTION

Policy identifies the responsibility of Maintenance and Operations Department to safeguard the investment made in public schools to keep all school buildings in safe condition and in good repair. This policy also defines the responsibility of the Facility Planning and Construction Department to effectively and efficiently manage the school system's long-range plans, construction programs and other major school building initiatives.

4. POLICY 7240 - ALTERATIONS TO FACILITIES

Wake County Board of Education Policy 7240, a new policy has been written to reflect that a Facilities Modification Form shall be submitted to the facilities planning office for review and approval by the Assistant Superintendent of Facilities of his/her designee when requesting alterations to facilities in the school system. This policy replaces Policy 2710 - ALTERATIONS OF FACILITIES AND EQUIPMENT.

Wake County Board of Education Policy 7250 states that any building site or other real property owned or held by the board I no longer suitable or necessary for public school purposes, the Superintendent or his designee shall determine the fair market value of the property, which may include soliciting offers to purchase the property. After the value of the property is determined, the board will offer the Wake County Commissioners the first opportunity to obtain the property at a fair market price. This policy will replace policy 8390 - SCHOOL PROPERTIES DISPOSAL.

Wake County Board of Education Policy 7261 establishes a dispute resolution system to facilitate the prompt and fair resolution of disputes with amounts in controversy in excess of $15,000 arising between or among any parties involved in the school system's construction and repair projects or construction process in accordance with N.C. 10. POLICY 8391 - DISPOSAL OF PERSONAL PROPERTY

Wake County Board of Education Policy 8391 has been revised to state that personal property may be disposed of by the school system in accordance with state law or through the facilities of the North Carolina Department of Administration. Also, the board may discard any personal property that is determined to have no value, remains unsold or unclaimed after the board has exhausted effects to sell the property using the procedures as provided by state law, or that poses a potential threat to public health or safety.

The general assembly recently amended the law that governs when a person may appeal a decision to the Board of Education. WE modified our grievance policy to conform to this legislative change. (115C-45) In addition, we clarified the time line for filing a grievance. NCAE reviewed and approved of these revisions to our policy.

15. POLICY 3219 - JOB DESCRIPTION FOR TEACHERS

The Department of Public Instruction recently approved a new evaluation instrument for teachers. The new evaluation form modified the specific duties upon which teachers are evaluated. We revised our job description for teachers to be consistent with the new evaluation form. NCAE reviewed and approved of these revisions to our policy.

16. POLICY 3230 - EVALUATION OF LICENSED EMPLOYEES

The Department of Public Instruction recently approved a new evaluation instrument for teachers. This policy was revised to be consistent with the new evaluation form and to add that principals may supplement the evaluation process as appropriate. NCAE reviewed and approved of these revisions to our policy.

Both RIF policies were revised to make it clear that the superintendent is authorized to limit or narrow the scope of any affected group to those employees who work in the school, facility, program, or department subject to the reduction in positions. In addition, we replaced a numerical performance method of identifying employees subject to a reduction in force with a factor based method. We believe this is a more workable approach or method. NCAE reviewed and approved of these revisions to our policy.
