1. BOOSTER PROGRAM FOLLOW-UP
Students who began at Mt. Vernon in August 2008 are currently enrolled in the ninth grade at Mary Phillips in such classes as English 9 and Algebra I part II. Fiscal Implications: No fiscal implications at this time. Recommendation for Action: This item is for information only.2. GOVERNMENT IMMUNITY
Presently, North Carolina has legislation, which grants governmental immunity to public schools and their employees. The Legislature is considering the adoption of a new law to eliminate governmental immunity for public schools, cities, and counties with some exclusions. Board members will receive information related to the impact of adopting this law. Fiscal Implications: None. Recommendation for Action: The item is presented for information only.3. OFFSITE ROAD IMPROVEMENTS FOR PANTHER CREEK HIGH
MODULARS
As a condition of approval of the site plan for installation of modular classroom units at Panther Creek High School, the Town of Cary requires that Wake County Public School System comply with its Adequate Public Facilities ordinance by constructing off-site improvements to highway NC-55. 1. REPORT OF ADMINISTRATION APPROVED CONTRACTS
The attached summaries are provided as information in accordance with Board Policy 8361. The summaries list all change orders, and contracts having a value greater than $50,000 and not over $100,000, and purchase orders in excess of $250,000 for January 2009. 1. UNDERGROUND STORAGE TANK (UST) REMOVALS AND SOIL
REMEDIATION SERVICES: H-7
Negotiations have been completed with Froehling & Robertson, Inc. to provide UST removals, environmental services, and additional assessment services for the H-7 school site for an amount not-to-exceed $139,824.50, in accordance with the Master Environmental Services Agreement. As part of the purchase agreement for H-7 site acquisition, an escrow account was established with the Seller's funds for the payment of costs associated with UST removal and remediation, and demolition of an existing house (and asbestos abatement related thereto) as is necessary to the remediation process. $216,000 is on deposit with Metro Title Insurance Company, who is serving as Escrow Agent, which amount was estimated to be 150% of the original estimated costs for remediation. WCPSS staff will manage the remediation processes, but the costs thereof will be paid directly from the escrowed funds. In addition to the contract with Froehling and Robertson, contracts with other vendors for asbestos abatement and demolition will be forthcoming and will be paid from the escrow funds, with an estimated cost of those additional services expected to be no more than $20,000. A copy of Froehling & Robertson's fee proposal, the Escrow Agreement, and a letter from the Title Insurance Company are attached hereto. Fiscal Implications: None. Funding is available from the seller's escrowed funds on deposit with Metro Title Insurance Company. Recommendation for Action: Board approval is requested.STUDENT ACHIEVEMENT
1. DRIVER EDUCATION CONTRACT RENEWAL 2009-2010
Statutory authority G.S. 20-881, 115C-216 and Title 16 of the N.C. Administrative Code provide enabling authority to contract for Driver Education Program Services.In July 2007, a new contract with the two-year renewal option was awarded to Jordan Driving School. We are completing the second year of the contract.Jordan Driving School has provided quality service to students and has cooperated regarding all program modifications.Recommend renewal of contract for Driver Education Program Services to Jordan Driving School, Inc. Fiscal Implications: Total projected contract cost is $2,140,000.00 based on 10,000 students. The N.C. Department of Transportation Allocation will fund all costs of the program for Driver Education. No local funds will be used to support this program. Recommendation for Action: This is presented to Wake County Public School System's Board of Education to approve the contract for Driver Education with Jordan Driving School for the period of July 1, 2009 to June 30, 2010.2. AMENDMENT ONE TO MAXIM HEALTHCARE SERVICES, INC.
Since the beginning of the school year, we have had an increase in the number of students requiring nursing services. We are increasing this contract by $150,000 to cover additional costs. Fiscal Implications: Funding is available in the Special Education Services' budget in the amount of $150,000 to pay the cost of these services. Recommendation for Action: Board approval is requested.3. TITLE I SUPPLEMENTAL EDUCATIONAL SERVICES: ACADEMIC PLUS
Under "No Child Left Behind", a Title I school that has not met Adequate Yearly Progress (AYP) goals for three consecutive years, must offer Supplemental Educational Services (SES) for all eligible students. Students are eligible if they qualify for free/reduced lunch. These services must be offered by a provider that is approved by the Department of Public Instruction. Parents select the provider from the approved list. Additional funds need to be encumbered to accommodate the second enrollment period at Wendell and York Elementary and to serve eligible students at Brentwood Elementary. Approximately 110 students at Wendell, York and Brentwood Elementary have selected Academics Plus as their SES provider. Fiscal Implications: The state-approved maximum allocation per student is $1,309.85. The total cost of the services for 110 students is $144,083.50. Recommendation for Action: Staff recommends the Board approve the amended contract.4. GRANT PROPOSALS

1. NAME FOR NEW HIGH SCHOOL IN RALEIGH (H-6)
On October 20, 2008, the Board of Education acquired 80.80 acres for use as a high school in the H-6 target area, with a school scheduled to open in 2011. Naming of the new high school is now required. The following names are proposed for consideration: (1) Northside High, (2) Forest Ridge High, (3) Creekside High, and (4) Oak Ridge High. Northside High is proposed as it identifies the area of the town in which the school site is located. Forest Ridge High is proposed because of the site's topography, its long history as forested land, and its location along Forestville Road. Creekside High is proposed because of the site's location along Big Branch Creek, which is the southern boundary of the site. Oak Ridge High is proposed because of the site's topography and existing vegetation. Staff recommends name selection of Forest Ridge High. Fiscal Implications: None. Recommendation for Action: Staff requests Board approval.POLICY
1. BOARD POLICY 2334 REGISTERED SEX OFFENDERS
New Policy: First Reading;; Request Waiver of Second Reading This is a new policy that was written by Tharrington Smith in response to NC House Bill 933/ S.L. 2008-117, The Jessica Lunsford Act. The Jessica Lunsford Act was written to put greater legal obligations and restrictions on registered sex offenders. This policy is written to further support the Jessica Lunsford Act.
